Subsistence of copyright

Subsistence of copyright

In the UK and European Community, Copyright and Unregistered Design Right protection subsist automatically once an original work has been created in a permanent form. In other countries, Copyright protection has to be registered before the right can be used to stop unauthorised third party copying.

The date of creation of the work is important to the start date of protection so it is important to keep accurate records and have evidence of this date.

In some countries, there is a facility for an author to register their work but this is no longer available in the UK. However, the work could be logged with us so that the date of Unregistered Right can be proven, if required, at some point in the future.
