Introduction to Registered Design Protection
Registered Design protection is granted on the basis of purely visual representations of a design in question and, to be registerable, a design must be new, have individual character, and must be visible to the eye during normal use of the design.A twelve month grace period is available which allows a design to be publicly disclosed prior to filing an Application for the Registered Design. However, we recommend that a Registered Design Application is filed at the earliest opportunity to ensure that a third party does not obtain an earlier filing date for the same or similar design at the Design Registry.
