What is Design Protection?

In the UK, some design works are automatically protected under Unregistered Design Rights but registering your design offers you broader protection.

Registering your design will:

  • Protect your design from being copied by unauthorised third parties
  • Protect any aspect of your design’s appearance, physical shape, configuration and decoration
  • Give you rights preventing others from using it for up to 25 years
  • Make legal action against infringement less complicated
  • Protect two-dimensional designs such as graphics, textiles and wallpaper

To register your design it must be original, inoffensive and your own intellectual property. It cannot include protected emblems or flags.

How does it work?

 

Three-dimensional designs may be automatically protected by Unregistered Design Rights but registering a design can provide better levels of protection.

 

Registered design protection is a valuable form of Intellectual Property protection. Registering a design is quick and relatively inexpensive. The process often takes only a few weeks or months.

Your registered design protection lasts up to 25 years but you are required to renew the registration every five years. Once registered, your design cannot be copied without your permission. If your design is copied then you can take legal action.
