Subsistence of Copyright and Unregistered Design Right
In the UK and European Community, Copyright and Unregistered Design Right protection subsist automatically once an original work has been created in a permanent form. In other countries, Copyright protection has to be registered before the right can be used to stop unauthorised third party copying.Since the date of creation of the work is important to the start date of protection, it is important to keep accurate records and advisable to have evidence of this date.
There is no longer any facility available in the UK by which an author can register their work as there is in some foreign countries. However, the work could be lodged with us so that the date of Unregistered Right can be proven, if required, at some point in the future.
